Following Werner Enterprises, Inc.’s (WERN) third quarter earnings warning, analysts at KeyBanc downgraded the transportation and logistics company on Tuesday.

The analysts downgraded WERN from “Buy” to “Hold.”

KeyBanc analyst Todd Fowler said, “We downgrade WERN from Buy to HOLD following its negative 3Q pre-ann’ct, which reflected a number of company-specific issues that we expect to limit upside going forward; we would focus investors on other, stronger-performing names within the truckload space, specifically, BUY-rated Swift Transportation Company (SWFT), Marten Transport Ltd. (MRTN), and Knight Transportation Inc. (KNX).”

The Company earns franchisee fees from its franchisees and advertisements (Ads). The Company offers its franchisees structures and financing options for franchise fees and royalty payments. The Company earns royalty revenue from its franchisees. Its franchise agreement requires franchisees to pay the Company a base royalty equal to 14% of the franchisee's tax preparation revenue, subject to certain specified minimums. Fran! chisees acquiring territories under its no franchise fee alternative will be required to pay it franchise royalties of 25% through their first five tax seasons, and thereafter 14% of their tax preparation revenue. The Company earns advertising fee revenue from its franchisees. Its franchise agreement requires all franchisees to pay the Company an advertising fee of 5% of the franchisee's tax preparation revenue.

The Company offers two types of financial products: refund transfer products, such as electronic refund checks (ERCs), which involve providing a means by which a customer may receive his or her refund, and refund-based loans, such as refund anticipation loans (RALs) and instant cash advances (ICAs). The Company earns fees from the use of these financial products. The Company also earns tax preparation revenue directly from both the operation of company-owned offices and the provision of tax preparation services through its eSmartTax online product.

    Data analysis specialist Splunk's (NASDAQ: SPLK  ) first-quarter report was a bit of a head-scratcher.

    Splunk shares took a 4% nosedive when the report was published, because its revenues came in strong but earnings were merely adequate. Revenue jumped 54% year over year to $57.2 million, easily topping Wall Street's $54 million target. The adjusted $0.06 loss per share was right in line with analyst expectations. That's just not good enough when your last three reports absolutely crushed Street targets on the bottom line, at least in percentage terms. The backlash was strong enough to suck data analysis rival TIBCO Software (NASDAQ: TIBX  ) down into a 1.5% drop in early Friday trading. There must be something wrong with this supposedly robust market, right?

    LOS ANGELES (MarketWatch) -- Japanese stocks rose in early Monday trading, with weaker-than-expected trade data pushing the yen lower, which in turn helped some export stocks. The Nikkei Stock Average (JP:NIK) added 1% to 14,704.36, with the broader Topix up 0.8%, also enjoying support from gains Friday in the U.S. After data showing exports grew less than analysts had projected, the dollar (USDJPY) moved back above the 98-yen level, sending some exporters climbing, with a 2.2% rise for Fujitsu Ltd.
